Obituary For David E. Schultz

Madison- David “Dave” E. Schultz, age 78, passed away peacefully with his wife of 49 years by his side on Friday, April 5, 2024. He was born on March 9, 1946, to Edward and Ruth (Krause) Schultz in Watertown, WI.

Dave grew up in Fort Atkinson and after skipping second grade graduated from Fort Atkinson High School in 1963. He received his Bachelor of Science in History in 1967 from the University of Wisconsin - Madison. He was drafted out of law school into the Army and served with the Military Police in Alaska. Dave later received his JD from the University of Wisconsin Law School, graduating in 1972.

After graduation Dave worked in Milwaukee for Corrections Legal Services and later returned to Madison. In 1981 he became Associate Dean, Continuing Legal Education and Outreach at the University of Wisconsin Law School, a position he held until retirement in July 2011. In this position he taught a variety of programs on criminal law for lawyers, judges, police officers and the first-year courses in Criminal Law and Criminal Procedure, along with supervising the judicial intern program.

In 1976 he started as the Reporter for the Wisconsin Criminal Jury Instructions Committee, a position he took great pride in, stepping down in 2019. He continued as an advisor to the Committee until his death. Dave was known as a valuable resource for Wisconsin‘s judges and a friend to many within the legal community. He authored many books with colleagues throughout his career.

Dave married Kristine (Burrows) on February 22, 1975, at First Congregational Church in Madison and had three children. Dave was a wonderful father; he never missed a sporting event or music performance. He was the morning carpooler and spent many decades driving many kids to daycare and school. He valued reading and could be seen from the front window every night with a book in his hand, his dog, and his Manhattan by his side. He enjoyed watching sports with his favorites being football, basketball, and golf. Dave was a lifelong Badger and shared this passion with his family. He loved spending time in Jacksonport on the shores of Lake Michigan in Door County; listening to the waves and watching his loved ones enjoy “Papa’s Beach.” He embraced his new role of papa and had a special connection with each of his grandchildren.

Dave was diagnosed with multiple myeloma which was successfully treated. He lost his life due to interstitial lung disease. We encourage you to consider organ donation. We would like to thank all of the medical providers at UW Health, especially Dr. Hall, Dr. Allard and Dr. Casper.

Dave is survived by his wife Kristine (Burrows) Schultz, his daughter Kathryn (Jason) Schmidt, sons David (Abby) Schultz and Andrew Schultz. His loving grandchildren: Evan & Abigail Schmidt; River, Seamus & Tatum Schultz; Taeya & Kailee Schultz and his special niece Amanda (Erick) Barden of Jefferson and many friends he considered family. He was preceded in death by his parents and brother.

A Celebration of Life Gathering will be held from 1:00 P.M. to 3:00 P.M. on Saturday, April 13, 2024, at Ryan Funeral Home, 2418 N. Sherman Ave, Madison, WI. A private family burial will be held at Natural Path Sanctuary in Verona, WI.

In lieu of flowers donations can be made to the Carbone Cancer Center or Door County Land Trust.

    Dave and I worked on many criminal law projects to together. We served together on the Judicial Council and worked especially hard on the revision of homicide law in Wisconsin. After the revision was passed into law, we spent several days at Green Lake, writing a piece about it. Dave was specially careful to get the stuff right!! Walter Dickey

    Dave was my law school classmate and later a Law School colleague. He was a "gentle giant", both as a man and as a legal scholar. The world needs both and will miss him now that he is gone.

    I had the privilege of sitting in Professor Schultz's criminal procedure class then working with him in the continuing ed office at the law school to finally serving with him on the criminal jury instructions committee. His institutional knowledge (he could reach back to recall what the committee did in the 70's), his wonderful sense of humor and his absolute commitment to ensuring excellence in all aspects of criminal law will be remembered by all who were lucky enough to work with him. He was a mentor and friend and will be missed.

    My condolences to Professor Schultz' family. I write to remember his kindness and knowledge. Years ago I was in an important trial as a DA and he obtained the correct jury instruction for me.     I had the honor and pleasure of working with Dave as a member of the Wisconsin Criminal Jury Instructions Committee from 2010 to 2020, my last 3 years as its Chair. He was an advisor to the committee of encyclopedic knowledge and unparalleled competence and professionalism. Every circuit court judge of this state who's ever presided over a jury trial is indebted to Professor Schultz. As a judge here in Door County, I know how much he loved the time he spent here. My and Cindy's sincere condolences to you, Kris, and your family.

    A special gift to the legal community. I got to know Dave as an advisor to the criminal jury instructions committee in the 1970s. Dave brought not only his enormous knowledge of the law to the committee, but his practical insights and skill at handling the various personalities of our circuit court judges and their own approaches to the practice of adjudication. As a judge myself years later, I benefitted greatly from my exposure to Dave's work. And, Dave's droll wit was special, too.
